2. APPLICATION OF THE GENERAL CONDITIONS OF SALE

These terms and conditions apply to the sale of products by SARL Les Chineurs de Malts, through its online store. They are automatically made available to the buyer on the homepage of the website www.leschineursdemalts.com

The buyer simply needs to click on “General Conditions of Sale” (hereinafter referred to as GCS) to find out the conditions of their order, even before they have started the ordering process.

Consequently, placing an order implies the buyer's full and unreserved acceptance of these T&Cs, to the exclusion of all other documents such as prospectuses and catalogues issued by the seller, which have only an indicative value.
The fact that the seller does not assert at any given time any of the provisions of this document cannot be interpreted as a waiver of the right to assert any of the said conditions at a later date.

Our offers are exclusively reserved for private customers, excluding professional resellers.

Orders are confirmed by sending the invoice, but are only final upon receipt of full payment.

3. PRICES

The final price displayed when validating the basket is the one that adds up the prices of the online store of the products you have chosen.

If the VAT rate were to change, either up or down, this change could be reflected in the price of the items.

All shipping to France is charged including tax.

Our prices are subject to change at any time without notice, however, the items ordered will be invoiced based on the price in effect at the time you pay for your order, subject to availability of the selected products.

4. SHIPPING COSTS

A contribution to packaging, insurance, and shipping costs is required for each order and is included in the delivery charges indicated before you confirm your order. Delivery charges are free for all purchases over €150 (excluding VAT).

The delivery address taken into account is the one indicated by you at the time of your order.
Delivery is made according to the delivery method chosen during the online ordering process.


5. ORDER

An order corresponds to a request for the removal of products and is the subject of a single invoice.

The Customer must provide the following information: full identity, email address, billing address. They must then select and add items to their cart, validate the cart and order, and finally select and validate their payment method. Any order entails an obligation to pay.
Final acceptance of the order is made by confirming the entry of bank details and by online payment, and is formalized by sending an email by the seller to the Customer.

The seller cannot be held liable in the event of non-performance or poor performance of contractual obligations attributable to the customer.

Les Chineurs de Malts reserves the right not to fulfill an order or to dispute the terms of an order and to only partially fulfill it in cases where:

– stocks do not allow the order to be fulfilled;
– the demand is considered abnormal in view of the volumes ordered
The Customer may modify or cancel his order at any time, which will only become final after confirmation and payment on the site.

6. PAYMENT

Payment Terms – General Conditions.
The price of the items ordered is payable in full to SARL Les Chineurs de malts: validation and payment of your basket – by credit card (secure online payment).


The sale price is due upon ordering and payment is deemed effective on the date the funds are actually present in the bank account of SARL Les Chineurs de Malts.

We have implemented a secure online credit card payment process for you. This process relies on information encryption technology, a true benchmark for secure payment.


How do I place an order by credit card on the website?
When you pay, you save your credit card numbers and expiration date, which are immediately encrypted on your computer before being sent over the Internet. This means that no confidential information is transmitted over the network without first being encrypted. Please note: only credit cards bearing the CB, VISA, EUROCARD, or MASTERCARD logo are accepted. Regardless of the payment method, any order will be canceled if payment has not reached the seller within 10 days of the order.

7. GUARANTEES

– Right of withdrawal

You have 14 (fourteen) days, starting from the day after receipt of your order, to exercise your right of withdrawal, without giving any reason or having to pay any penalties. When the period expires on a Saturday, Sunday or public holiday, it is extended until the next working day.

After informing you of your choice to exercise your right of withdrawal, you have a further period of 14 (fourteen) days to return the product(s) concerned by the withdrawal.

Returns and refunds: When you exercise your right of withdrawal, the price of the product(s) purchased will be refunded to you.

Return shipping costs are your responsibility and the return conditions must be similar to those of the initial shipment. Products must be returned in their original condition, intact, complete (unopened products, original packaging, instructions, warranty certificate, accessories, etc.), clean and in a condition suitable for sale. In the event of damage to the product resulting from improper handling on your part, you may be held liable. No goods may be returned to Les Chineurs de Malts without prior notice and in accordance with its reshipping instructions.

To exercise this right, you must, within the aforementioned 14-day period, notify us of your decision to withdraw from this contract by means of an unambiguous statement (for example, a letter sent by post or email).

SARL LE CHINEURS DE MALTS will contact you as soon as possible to process your request and, if necessary, offer you an alternative.

If SARL LES CHINEURS DE MALTS confirms your right of withdrawal, SARL LES CHINEURS DE MALTS will reimburse you, without undue delay, the amount corresponding to the product subject to withdrawal and in any event, no later than 14 (fourteen) days following receipt by SAR LES CHINEURS DE MALTS of the returned goods. The costs of any return of the product remain your responsibility.

You must return the item subject to withdrawal, in perfect condition, and with all its accessories if applicable to the following address, without undue delay and, in any event, no later than 14 (fourteen) working days after confirmation by email from SARL LES CHINEURS DE MALTS that your withdrawal request has been taken into account. This deadline is deemed to have been met if you return the item before the expiry of the fourteen-day period, at your expense and via a suitable delivery method, to the following address:

SARL LES CHINEURS DE MALTS will make the refund using the same means of payment as for the initial transaction, unless a different means is expressly agreed; in any event, this refund will not incur any costs for you.

– Legal guarantee of conformity for consumer goods

LES CHINEURS DE MALTS products all benefit from the legal guarantee of conformity provided for in Articles L. 217-4 to L. 217-14 of the Consumer Code and the legal guarantee of hidden defects provided for in Articles 1641 to 1649 of the Civil Code.

Under these guarantees, LES CHINEURS DE MALTS undertakes, depending on your choice, to reimburse or exchange the products:

– apparently defective, damaged or not corresponding to the order,

– against hidden defects arising from a material, design or manufacturing defect affecting the products delivered and making them unfit for use.

If the product(s) delivered do not comply with the order, you must send, within a reasonable time after receipt, a written request to LES CHINEURS DE MALTS in order to obtain a refund or replacement of the Product(s).

As a reminder, the guarantees attached to the products sold on our site are provided for in the following articles:

Article L217-4 of the Consumer Code

"The seller delivers goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when this has been made his responsibility by the contract or has been carried out under his responsibility."

Article L217-5 of the Consumer Code

“The property complies with the contract:

1° If it is suitable for the use usually expected of a similar good and, where applicable:

- if it corresponds to the description given by the seller and has the qualities that the latter presented to the buyer in the form of a sample or model;

- if it presents the qualities that a buyer can legitimately expect in view of the public statements made by the seller, by the producer or by his representative, in particular in advertising or labeling;

2° Or if it presents the characteristics defined by mutual agreement by the parties, delivery of the good.

Article 1641 of the Civil Code

"The seller is bound by the guarantee for hidden defects in the item sold which make it unfit for the use for which it is intended, or which reduce this use so much that the buyer would not have acquired it, or would have paid a lower price for it, if he had known of them."

Article 1648 al 1st civil code

“The action resulting from latent defects must be brought by the purchaser within two years of the discovery of the defect.”

Any warranty is excluded in the event of misuse, negligence or lack of maintenance on your part, as well as in the event of normal wear and tear of the product, accident or force majeure. The warranty is limited to the replacement or refund of non-compliant or defective products. You are solely responsible for the choice of products, their storage and their use in accordance with the precautions for use.

8. RESPONSIBILITIES

Regarding the sale of alcohol, LES CHINEURS DE MALTS reminds you that minors are not legally allowed to order on the site.

LES CHINEURS DE MALTS invites you to refuse any package that is damaged and to notify its Customer Service, in writing and in detail, of your reservations within 3 days, keeping proof of your written request. Otherwise, LES CHINEURS DE MALTS considers that you have received the products in a condition that gives you complete satisfaction.

In accordance with Article L. 612-1 of the Consumer Code, you can use the free mediation service of the Centre de Médiation et d'Arbitrage de Paris (CMAP), to which we belong electronically: cmap@cmap.fr, by post to PARIS (75008) – 39 Avenue Franklin Rossevelt.

The buyer, prior to placing an order, declares that:

9. INTELLECTUAL PROPERTY RIGHTS

11. Applicable law

These T&Cs may be modified at any time. The new general terms and conditions of sale will only apply to sales made after the modification.

French law is applicable and any difficulty or dispute not settled by mediation will fall under the exclusive jurisdiction of the French courts.
